death in family

By Terry Savage on April 22, 2025 | Credit/Debt

I am 55 and my brother is 50. Our mother passed 2 weeks ago. She is in a better place now alongside our father. She has left $40,00 in credit card debt. A house that’s paid off and a car. The debt is split between 2/3 cards. We spoked with a lawyer who gave us 3 scenarios. 1. They work with you on a lower amount +- 60%. 2. take them to court and they don’t show. Mening the debt is forgotten. Or they fight you. 3. They have 90 days to make a claim. Our biggest concern the interest. My brother wants to call the company’s and ask for relief on the interest. would this be a good move to make?

YOU DO NOT OWE ANYTHING ON THESE CARDS! Assuming they are standard cards, and your names are not on them, the debt is considered UNSECURED, and you have no obligation to repay the balance. They are not a lien against the value of the house.
Just send the next bill back and write “deceased” on the payment stub. They will get the message.
They cannot come after the estate or the heirs if these were just standard credit cards.

GET A NEW LAWYER! Your lawyer has no idea what he/she is talking about!!!
