durable power of attorney

By Terry Savage on March 22, 2025 | Financial Planning / Retirement

I’m filling out my durable poa. Should i list my wife as primary and then someone else my secondary(probably my son). Even though my wife is listed as co owner on most everything thanks. My friend just passed away and we couldn’t do anything why he was hospitalized. Thanks

Well, actually you should have two different powers of attorney — one for financial and one for healthcare. You should also have a living will, specifying clearly what end-of-life measures you do, and do not, want taken.

Here is a link to the Illinois Healthcare Power of Attorney form.

And this link will take you to a durable power of attorney form.

But I highly recommend you seek an estate planning attorney and re-do your entire estate plan, creating a revocable living trust and re-naming all your joint assets into the trust — with both of you as co-trustees, and your son as successor trustee.
