Ask Terry Questions Ex-Wife Drawing Social Security

Ex-Wife Drawing Social Security

By Terry Savage on March 24, 2025 | Social Security

My husband and his ex-wife were married for 18 years. He and I have also been married for 18 years. She turns 66 in 3 months and has recently applied to draw on my husband’s social security. (I am 56 years old.) When I turn 65, will I also be able to draw on my husband’s social security or is she now the only person who can?

Terry Says

No, you both — since both were married 10 years, and presumably she is not remarried — can claim on his SS record — IF it is larger than your own!
