My nephew (56) has been disabled for years from multiple heart attacks. He has Medicaid health insurance, but no income—just a modest monthly NY State food allowance. I asked him if he applied for SSDI—years ago he made a nice living in auto sales.
He said yes, but that he was denied for a lack of work history. I said you’ve worked a lot more than 10 years (40 quarters) and should qualify. He said that when he applied to the local Social Security office that they said he didn’t qualify for SSDI because eligible is based on the most recent 10 years! I told him the gal who ‘helped’ him is wrong and he should go back and ask for a supervisor.
Who’s right—the uncle or the Social Security clerk?

I think at this point he needs to hire an attorney who specializes in getting SSDI benefits for claimants. There are plenty of them if you search. I’m not an expert, but it seems to me he should qualify — even belatedly — from everything I’ve read on the subject.
