WEP and Fairness Act applicable to deceased spouse ?
My late husband was a CPS Substitute Teacher for 17 years and also had his 40 quarters of credited work under social security. He took his SS at Age 62 since he had many health issues and was no longer able to work. He received this pension from CPS after we “bought back” the three years of service he still needed to qualify for it. The pension amount was very minimal. His social security was also very minimal due to the WEP rules in effect at the time. There was no way we would have been able to live on the combined SS and pension. I continued to work full time to Age 71 and delayed taking my own SS in order to increase my benefit because I knew it would be the better than taking the spousal benefit. He has since passed away almost 6 years ago, but I am wondering if there is a possibility that he would be eligible for any type of payment for the years he missed out of his full SS amount due to WEP. I was his representative payee at the time of his death, Thank you.
